Prices
Prices and terms are subject to change without notice. Prices are those in effect on date of shipment. All agreements are contingent upon strikes, accident or other causes beyond our control.

Additions, Changes and Cancellations
Since each order is immediately entered for processing, instructions to add items or to change quantities on orders already accepted will be at the discretion of Timberland Machines & Irrigation, Inc. Cancellation of any order after acceptance by Timberland Machines & Irrigation, Inc. may result in a penalty charge, the amount of which will be determined by the status of that order at that particular time.

Returned Goods
Goods may not be retuned without a Returned Goods Authorization and accompanied by the original invoice. There will be a 15% restocking charge on all returns except for defective items. Only merchandise credits will be issued. No refunds will be made. Goods more than 90 days old will not be accepted unless prior approval with shipping instructions has been obtained from Timberland Machines & Irrigation, Inc. If permission to return this material is granted, the amount of credit to be allowed will be governed by the circumstance involved.

Errors and Claims
Timberland Machines & Irrigation, Inc. will make good its errors, but cannot assume the responsibility for the errors of others. All claims for shortages must be made within 10 calendar days from the date of shipment. All claims for damage or shortages resulting from shipping and handling must be made direct to the carrier.

Finance Charge
This invoice is due and payable upon receipt. Purchaser agrees as a condition of the sales that this invoice will be subject to a finance charge of 1 1/2% per month, (annual percentage rate of 18%), if unpaid for 30 days. If invoice is placed with an attorney for collection, purchaser further agrees as a condition of the sales to pay all costs of collection, including reasonable attorney's fees.

WHILE THE MANUFACTURER MAY WARRANT THE GOODS SOLD TO THE CUSTOMER, TIMBERLAND MACHINES & IRRIGATION, INC. MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO SUCH GOODS.
